No blanket ban on students with upper limb impairment in medical course, High Court
D.N.I.S. News Network, India: The Bombay High Court has ruled against the blanket embargo on students with upper limb disabilities from taking admission into M.B.B.S. course.In an interim order, a division bench of Chief Justice Mohit Shah and Justice Nitin Jamdar directed the Director of Medical Education and Research to consider such applicants as eligible and fit for the medical course.The bench was hearing the petition of a 17 year old girl who wasrefused admission despite featuring on the merit list in the disabled category on the ground that she had 50 percent permanent impairment of the upper limb.
The Court noted that the Delhi and Madras High Courts had earlier considered the Medical Council of India's guidelines and had held that there cannot be any absolute embargo upon the admission of students with impairment of the upper limb.
