Delhi High Court admits petition on non-implementation of Disability Act
D.N.I.S. News Network- The Delhi High Court has admitted a Public Interest Litigation on the non-implementation of the Disability Act 1995, based on a letter by Convenor of Disabled Rights Group Javed Abidi to Justice Mukul Mudgal drawing attention to the issue.
The letter details matters like the identification of jobs for disabled people, social security and corporate incentives to promote the employment of disabled people in the private sector, promised in the Disability Act passed over a decade ago. The letter was converted into a petition and admitted by the Hon’ble High Court on 20 December 2005. It questions the implementation of the following provisions of the Act:
1) The identification of jobs for persons with disabilities (Section 33)
2) Declaration of Incentive Policy (Section 41)
3) Social Security for disabled people registered with Special Employment Exchanges for two years or more (Chapter XIII)
The Hon’ble High Court has issued notices to Government of National Capital Territory of Delhi, Ministry of Social Justice and Empowerment, Ministry of Finance, Ministry of Commerce and Ministry of Home Affairs, seeking response to the issues raised in the petition to be filed in six weeks time. The date of the next hearing is 3 February 2006.
